The implementation of an artificial neural network for predicting induction heating region locations is proposed in this research. Steel plate deformations during the induction heating process are produced using an analytical solution derived from electromagnetic and plate theory. The plate transform following vertical displacements in each divided area was used as input of neural following desired shape of the steel plate and the specified heating areas for induction treatment as output parameters to predict and evaluate the model. A dataset used (...) 90% for training and remaining 10% for testing to implement on the efficient models when changing hidden layer and its neurons relatively. The trial and error for analyzing and predicting heating-affected regions with the ANNs model reached the high average accuracy and lowest mean square error at 98.08% and 0.00913, respectively. Consequently, the feasibility test indicates that the developed approach may be well utilized to identify the heating positions by grid area in order to achieve the desired plate deformation. Moreover, the analysis of vertical displacement during induction heating and its response behaviour of steel plate based on thermo-mechanical are also addressed. (shrink)

This paper proposes several recurrent neural network-based models for recognizing requisite and effectuation parts in Legal Texts. Firstly, we propose a modification of BiLSTM-CRF model that allows the use of external features to improve the performance of deep learning models in case large annotated corpora are not available. However, this model can only recognize RE parts which are not overlapped. Secondly, we propose two approaches for recognizing overlapping RE parts including the cascading approach which uses the sequence of BiLSTM-CRF models (...) and the unified model approach with the multilayer BiLSTM-CRF model and the multilayer BiLSTM-MLP-CRF model. Experimental results on two Japan law RRE datasets demonstrated advantages of our proposed models. For the Japanese National Pension Law dataset, our approaches obtained an \ score of 93.27% and exhibited a significant improvement compared to previous approaches. For the Japan Civil Code RRE dataset which is written in English, our approaches produced an \ score of 78.24% in recognizing RE parts that exhibited a significant improvement over strong baselines. In addition, using external features and in-domain pre-trained word embeddings also improved the performance of RRE systems. (shrink)

Human contact is a key issue in social interactions for autonomous systems since robots are increasingly appearing everywhere, which has led to a higher risk of conflict. Particularly in the real world, collisions between humans and machines may result in catastrophic accidents or damaged goods. In this paper, a novel stop strategy related to autonomous systems is proposed. This control method can eliminate the vibrations produced by a system’s movement by analysing the poles and zeros in the model of autonomous (...) vehicles and goods. Using the pole placement technique, the motion of a system is guaranteed to be more stable, more flexible and smoother. Moreover, several control profiles are employed in the switching mechanism to choose the proper vibration-free effect. The main contributions of this paper are the recommendation of an active stopping planner using different smooth generators from a modelling study, the validation of their physical characteristics and the launching of a switching algorithm based on the socially aware navigation framework of a robot. This theoretical work is based on the virtual environment of MATLAB, and the experiment is implemented in the practical platform of an automated guided vehicle. From these results, it can be seen that the proposed approach is robust, effective and feasible for applications in storehouse management, public transportation or factory manufacturing. (shrink)

There is a prominent phenomenon in the religious life of Vietnam, which is the emergence of “new religions”. These phenomena have not only made the religious space of the nation more complex and multi-dimensional but also challenged stability and sustainable development within the religious communities in this key economic region. Having studied the new religious phenomenon in recent years, we have noted its progress and widespread characteristics within the ethnic communities. While it may appear that "new religion" is a simple (...) and gentle concept and practice, it is in fact, intrinsically related to and has significant implications on the social life of the community members. However, there is a growing concern, considerable suspicion and anxiety with regards to its impacts on individuals, families, social and cultural traditions, beliefs and religions; many have opined that it is radically changing the peaceful cohabitation of diverse religious traditions, revealing a potential for conflicts across groups. Based on the religious reality of the Southern region of Vietnam, the Center for Religion Studies has implemented a project regarding new religions in Ho Chi Minh City and the problems faced by the religious policy in Vietnam. The annotated dataset is an essential requirement to develop an artificial intelligence system effectively and expect the generalization of the predictive models and to avoid overfitting. Lack of the training data is a big barrier so that AI systems can broaden in several domains which have no or missing training data. Building these datasets is a tedious and expensive task and depends on the domains and languages. This is especially a big challenge for low-resource languages. In this paper, we experiment (...) and evaluate many various approaches on sentiment analysis problems so that they can still obtain high performances under limited training data. This paper uses the preprocessing techniques to clean and normalize the data and generate the new samples from the limited training dataset based on many text augmentation techniques such as lexicon substitution, sentence shuffling, back translation, syntax-tree transformation, and embedding mixup. Several experiments have been performed for both well-known machine learning-based classifiers and deep learning models. We compare, analyze, and evaluate the results to indicate the advantage and disadvantage points of the techniques for each approach. The experimental results show that the data augmentation techniques enhance the accuracy of the predictive models; this promises that smart systems can be applied widely in several domains under limited training data. Currently, although the implementation of corporate social responsibility (CSR) practices and its incorporation into business strategies is emphasised widely in developed countries as a key to sustainable growth and economic profitability, this term is still new to the Vietnamese market because of the low awareness of the importance of CSR practices, which leads to the failure of many firms. Since Vietnamese firms do not prioritise CSR implementation, Vietnam is experiencing an increasing shortage of skilled employees owing to a lack of (...) motivation. Therefore, this study examines the relationship between the corporate strategic objective (CSO), CSR practices and employee commitment, to provide recommendations to enhance motivation. This study used a quantitative approach and data from a questionnaire delivered to 869 enterprises in 2019 in Vietnam. Results suggest that the CSO had direct and indirect effects on employee commitment through the mediation of CSR practices. (shrink)

Cảm xúc là yếu tố cơ bản thúc đẩy con người đưa ra quyết định và xử lý thông tin. Sợ hãi là một trong những cảm xúc phổ biến nhất ảnh hưởng đến hành vi của nhà đầu tư cá nhân trên thị trường chứng khoán. Mặc dù nhiều nghiên cứu đã được thực hiện để khám phá tác động của nỗi sợ hãi đối với hiệu quả đầu tư và hành vi giao dịch của nhà đầu tư cá (...) nhân, nhưng vẫn còn rất ít thông tin về các yếu tố ảnh hưởng đến nỗi sợ hãi của nhà đầu tư cá nhân trong thời kỳ thị trường sụt giảm (hoặc những giai đoạn cực kỳ biến động). Vì thế, nghiên cứu này được thực hiện để tìm hiểu liệu các nguồn thông tin ảnh hưởng đến quyết định đầu tư của nhà đầu tư có ảnh hưởng đến sự sợ hãi của họ khi khủng hoảng xảy ra hay không. Nghiên cứu đã sử dụng phương pháp phân tích Bayesian Mindsponge Framework (BMF) trên bộ dữ liệu từ 1526 nhà đầu tư Trung Quốc và Việt Nam. Kết quả nghiên cứu chỉ ra rằng các nhà đầu tư tiếp cận các loại thông tin khác nhau khi đưa ra quyết định đầu tư sẽ ảnh hưởng đến tần suất phản ứng sợ hãi khác nhau. Cụ thể, các nhà đầu tư tham khảo thông tin từ chuyên gia hoặc tự phân tích khi đưa ra quyết định đầu tư ít bị đóng băng (biểu hiện của tâm lý sợ hãi) hơn trong thời kỳ thị trường sụt giảm. Ngược lại, những người đưa ra quyết định đầu tư dựa trên thông tin từ người quen hay bạn bè và trực giác sẽ bị đóng băng thường xuyên hơn. Kết quả nghiên cứu này giúp gợi ý nhà đầu tư cá nhân nên trang bị cho mình các kiến thức về tài chính cũng như tham khảo các ý kiến chuyên gia trên thị trường, hoặc những nguồn thông tin đáng tin cậy, khi đưa ra quyết định đầu tư. Giải quyết biến đổi khí hậu và ô nhiễm môi trường đang và sẽ là thách thức lớn của nhân loại trong thế kỷ 21. Con người không còn nhiều thời gian để sửa chữa, phục hồi đưa hệ sinh thái môi trường (tự nhiên) trở về trạng thái an toàn. Trong khi các nỗ lực trong thời gian qua chưa thực sự hiệu quả thì COP26 mở ra cơ hội lớn để nhân loại tiến gần đến mục tiêu kiềm (...) chế nhiệt độ của trái đất không vượt quá 1.5 độ C. Mặc dù Việt Nam cùng với 146 quốc gia trên thế giới đã có cam kết mạnh mẽ nhất trong việc giảm phát thải vào năm 2050, tuy nhiên việc cụ thể hóa cam kết thông qua các giải pháp sáng tạo là rất quan trọng. Sử dụng (áp dụng, vận dụng) hệ sáng tạo 3D và nguyên lý bán dẫn giá trị, tác giả đề xuất hệ sinh thái “giải pháp trụ cột” cần thực hiện gồm có tăng cường thông tin, truyền thông, nghiên cứu khoa học về môi trường (biến đổi khí hậu, ô nhiễm môi trường...); xây dựng, chuyển đổi và nâng cao văn hóa và môi trường; đẩy mạnh phát triển kinh tế gia tăng phúc lợi; xây dựng (chuyển đổi) lớp doanh nhân có văn hóa, trách nhiệm môi trường; tăng cường mở rộng sự hợp tác quốc tế về mọi mặt đặc biệt là trong lĩnh vực kinh tế, truyền thông và khoa học; và thực thi các giải pháp nêu trên một cách kỷ luật. The linkage between ethical judgment and ethical behavioral intention was investigated. The Multidimensional Ethics Scale (MES) was used to measure ethical judgment ratings of hypothetical behaviors in retail, sales, and automobile repair scenarios. Confirmatory factor analysis on a sample of 300 undergraduate business students showed that a model with three latent variables representing three correlated ethical dimensions of moral equity, relativism, and contractualism, three correlated scenario latent variables, and correlated residuals presented a good fit to the data. Further, structural models (...) of the relationship of ethical judgment to behavioral intentions revealed that behavioral intentions were more highly related to the scenario factors than to the ethical dimensions across three scenarios. Adding a method factor to the model improved goodness-of-fit and changed some structural model conclusions. (shrink)

We consider a fishery model with two sites: (1) a marine protected area (MPA) where fishing is prohibited and (2) an area where the fish population is harvested. We assume that fish can migrate from MPA to fishing area at a very fast time scale and fish spatial organisation can change from small to large clusters of school at a fast time scale. The growth of the fish population and the catch are assumed to occur at a slow time scale. (...) The complete model is a system of five ordinary differential equations with three time scales. We take advantage of the time scales using aggregation of variables methods to derive a reduced model governing the total fish density and fishing effort at the slow time scale. We analyze this aggregated model and show that under some conditions, there exists an equilibrium corresponding to a sustainable fishery. Our results suggest that in small pelagic fisheries the yield is maximum for a fish population distributed among both small and large clusters of school. (shrink)

Religious conversion is a phenomenon that has frequently occurred in human history. As part of religious life, religious conversion reflects fluctuations and changes in social existence, especially changes in the economic, cultural, social, religious factors and one‟s own subjective religious convictions. Religious conversions are taking place in the ethnic communities in Southern Vietnam, but in a context that is space and time specific. So the process of evolution, the nature, dynamics and characteristics of the case of religious conversion here is (...) different and unique. Currently, the study of religious conversion in Vietnam in general and the South in particular, is modest. There have not been many studies regarding case specific religious conversion of people and no studies have done a full assessment of the nature and characteristics of religious conversion on social life in Southern Vietnam as well as forecasted the evolution and impact of the same. Recent conversation has blurred two very different social epistemic phenomena: echo chambers and epistemic bubbles. Members of epistemic bubbles merely lack exposure to relevant information and arguments. Members of echo chambers, on the other hand, have been brought to systematically distrust all outside sources. In epistemic bubbles, other voices are not heard; in echo chambers, other voices are actively undermined. It is crucial to keep these phenomena distinct. First, echo chambers can explain the post-truth phenomena in a way that epistemic (...) bubbles cannot. Second, each type of structure requires a distinct intervention. Mere exposure to evidence can shatter an epistemic bubble, but may actually reinforce an echo chamber. Finally, echo chambers are much harder to escape. Once in their grip, an agent may act with epistemic virtue, but social context will pervert those actions. Escape from an echo chamber may require a radical rebooting of one's belief system. Van Fraassen argues that data provide the target-end structures required by structuralist accounts of scientific representation. But models represent phenomena not data. Van Fraassen agrees but argues that there is no pragmatic difference between taking a scientific model to accurately represent a physical system and accurately represent data extracted from it. In this article I reconstruct his argument and show that it turns on the false premise that the pragmatic content of acts of representation include doxastic commitments.

This study aims at putting characterology to the test of the epistemology presented in J.C. Pariente's work, Language and the Individual. This epistemology requires certain conditions for a knowledge of the individual to be valid, i.e., to be at the same time conceptual and adapted to its individual object. By following characterologists in their work, the study concludes that the characterological processes have met the conditions demanded by Pariente's epistemology. So, one cannot say that characterology, like history, "is not a (...) conceptual knowledge of its object". (shrink)

In this paper, semi-Post algebras are introduced and investigated. The generalized Post algebras are subcases of semi-Post algebras. The so called primitive Post constants constitute an arbitrary partially ordered set, not necessarily connected as in the case of the generalized Post algebras examined in [3]. By this generalization, semi-Post products can be defined. It is also shown that the class of all semi-Post algebras is closed under these products and that every semi-Post algebra is a semi-Post product of some generalized (...) Post algebras. (shrink)

Solidarity is a valuable tradition of Vietnam Communist Party and Vietnamese people and Ho Chi Minh is the personification of the great national Solidarity. Ho Chi Minh Solidarity is reflected by tolerant, which is not tight in national matter but also extends to the contemporary world. This is the foundation of national Solidarity as well as international Solidarity to the liberating, building and developing carier of a country. It is difficult to reach a common point between 54 minority ethnics in (...) all around Vietnam with different culture, custom, religious beliefs. However, Ho Chi Minh, by his thinking and action, he was successful in establishing a great united bloc of all the minority ethnics in Vietnam. It leads to a happy, comfortable and peaceful life. The host actin nucleation machinery is subverted by many bacterial pathogens to facilitate their entry, motility, replication, and survival. The majority of research conducted in the past primarily focused on exploitation of a host actin nucleator, the Arp2/3 complex, by bacterial pathogens. Recently, new studies have begun to explore the role of formins, another family of host actin nucleators, in bacterial pathogenesis. This review provides an overview of recent advances in the study of the exploitation of the Arp2/3 complex and (...) formins by bacterial pathogens. Secreted bacterial effector proteins seem to manipulate the regulation of these actin nucleators or functionally mimic them to drive bacterial entry, motility and survival within host cells. An enhanced understanding of how formins are exploited will provide us with greater insight into how a fundamental eurkaryotic cellular process is utilized by bacteria and will also advance our knowledge of host‐pathogen interactions. This book offers an innovative approach to the analysis of the current crisis in the South China Sea. Moving beyond the spirit of the UN Convention on the Law of the Sea (UNCLOS), the mechanisms of which are limited to physical geography, it demonstrates how epistemological insights from the field of critical realist philosophy can reveal the importance of cultural and structural conditioning processes in social interactions, processes which shape the conditions for the emergence of crisis points along a spectrum (...) of conflict and cooperation. The potential for conflict resolution and the emergence of new regions in Pacific Asia much depends on the nature of such interactions at many levels (political-economic, semiotic and cultural) based on perceptions of what constitutes the "common" versus a Sinicised version of "Lebensraum". According to most accounts of trust, you can only trust other people (or groups of people). To trust is to think that another has goodwill, or something to that effect. I sketch a different form of trust: the unquestioning attitude. What it is to trust, in this sense, is to settle one’s mind about something, to stop questioning it. To trust is to rely on a resource while suspending deliberation over its reliability. Trust lowers the barrier of monitoring, challenging, checking, (...) and questioning. Trust sets up open pipelines between yourself and parts of the external world. Trust permits external resources to have a similar relationship to one as one’s internal cognitive faculties. This creates efficiency, but at the price of exquisite vulnerability. We must trust in this way because we are cognitively limited beings in a cognitively overwhelming world. Crucially, we can hold the unquestioning attitude towards objects and technologies. When I trust my climbing rope, I stop worrying about its reliability. When I trust my online calendaring system, I simply go to the events indicated, without question. But, one might worry, how could one ever hold such a normatively loaded attitude as trust towards mere objects? How could it ever make sense to feel betrayed by an object? Trust is our engine for expanding and outsourcing our agency — for binding external processes into our practical selves. Thus, we can be betrayed by our smartphones in the same way that we can be betrayed by our memory. When we trust, we try to make something a part of our agency, and we are betrayed when our part lets us down. To unquestioningly trust something is to let it in—to attempt to bring it inside one’s practical functioning. This suggests a new form of gullibility: agential gullibility, which occurs when agents too hastily and carelessly integrate external resources into their own agency. (shrink)

Games may seem like a waste of time, where we struggle under artificial rules for arbitrary goals. The author suggests that the rules and goals of games are not arbitrary at all. They are a way of specifying particular modes of agency. This is what make games a distinctive art form. Game designers designate goals and abilities for the player; they shape the agential skeleton which the player will inhabit during the game. Game designers work in the medium of agency. (...) Game-playing, then, illuminates a distinctive human capacity. We can take on ends temporarily for the sake of the experience of pursuing them. Game play shows that our agency is significantly more modular and more fluid than we might have thought. It also demonstrates our capacity to take on an inverted motivational structure. The rapidly evolving space tourism industry faces significant challenges in building consumer trust and balancing emotional appeal with factual accuracy—both essential for reducing uncertainty and fostering long-term public engagement in this high-risk sector. This study examines the key factors shaping individuals’ intentions to participate in space tourism, with a focus on their perceived trustworthiness, usefulness, and immersiveness of information on social media. Applying Mindsponge Theory, we explore the interplay between trust evaluation and subjective cost-benefit judegement of individuals in high-risk tourism (...) context. The findings reveal that while trustworthiness positively influences participation intention, its role diminishes when usefulness and immersiveness are particularly strong. This suggests that space tourists, who are naturally inclined toward risk-taking, prioritize experiential rewards—such as novelty, prestige, and emotional engagement—over concerns about information reliability. These insights offer practical implications for marketing in high-risk industries, highlighting the importance of immersive storytelling, exclusivity, and transformative experiences over conventional trust-building measures. Future research should investigate how personal risk tolerance, prior experience, and cognitive biases shape thought processes, decision-making, and behaviors in extreme tourism contexts. (shrink)

There seems to be a deep tension between two aspects of aesthetic appreciation. On the one hand, we care about getting things right. On the other hand, we demand autonomy. We want appreciators to arrive at their aesthetic judgments through their own cognitive efforts, rather than deferring to experts. These two demands seem to be in tension; after all, if we want to get the right judgments, we should defer to the judgments of experts. The best explanation, I suggest, is (...) that aesthetic appreciation is something like a game. When we play a game, we try to win. But often, winning isn’t the point; playing is. Aesthetic appreciation involves the same flipped motivational structure: we aim at the goal of correctness, but having correct judgments isn’t the point. The point is the engaged process of interpreting, investigating, and exploring the aesthetic object. Deferring to aesthetic testimony, then, makes the same mistake as looking up the answer to a puzzle, rather than solving it for oneself. The shortcut defeats the whole point. This suggests a new account of aesthetic value: the engagement account. Games occupy a unique and valuable place in our lives. Game designers do not simply create worlds; they design temporary selves. Game designers set what our motivations are in the game and what our abilities will be. Thus: games are the art form of agency. By working in the artistic medium of agency, games can offer a distinctive aesthetic value. They support aesthetic experiences of deciding and doing. -/- And the fact that we play games shows something remarkable about us. (...) Our agency is more fluid than we might have thought. In playing a game, we take on temporary ends; we submerge ourselves temporarily in an alternate agency. Games turn out to be a vessel for communicating different modes of agency, for writing them down and storing them. Games create an archive of agencies. And playing games is how we familiarize ourselves with different modes of agency, which helps us develop our capacity to fluidly change our own style of agency. (shrink)

As gatekeepers, editors and reviewers play a central role in identifying reliable and valuable scientific works for preservation and dissemination, contributing to subsequent knowledge production and public use. Despite its benefits, the rejection mechanism often carries significant emotional and career consequences for researchers. The analysis of 304 rejection letters since 2022 indicates that over 97% of rejections were attributed solely to authors’ shortcomings or the journal’s rigorous evaluation standards, while less than 3% cited journal-side limitations. This pattern suggests a prevailing (...) tendency where journals position themselves as the standard of quality, implicitly framing rejected research as inherently unqualified and placing an undue burden on authors—the primary producers of knowledge. Given the fallibility of journals, we propose a shift from viewing them as gatekeepers to recognizing them as facilitators of knowledge production. This transition would require embracing intellectual humility, thereby alleviating the rejection-induced burdens on researchers and fostering a more constructive scholarly environment. (shrink)

This study examines the dynamic relationship between face-saving mechanisms—proxied by age, income, and gender—and the peers’ safe-driving information on the driving behaviors of Chinese drivers. Using the Bayesian Mindsponge Framework (BMF) and Granular Interaction Thinking Theory (GITT) to analyze data from 1,039 Chinese drivers, we uncover a complex interplay of factors. Our findings suggest that peers serving as role models and actively supporting careful driving positively influence drivers’ safe driving behaviors. The effect of role-model peers is strengthened among drivers with (...) higher age and income levels. In contrast, the impact of actively engaged peers is lower among these groups and male drivers (though the gender’s negative moderation effect is weakly reliable). These results highlight the crucial role of peer influence in promoting safe driving and underscore the dynamic effects of cultural values, particularly face-saving concerns, on drivers’ cognitive and behavioral processes in China. Based on the research results of a scientific research on the topic, “Cultural and religion life in Ho Chi Minh City in the era of international integration”, we would like to share some opinions about the characteristics of culture and religions in the process of cultural exchange, acculturation and accumulation of Ho Chi Minh City from traditional to modern stage. The Cham Balamon people in Vietnam are an ethnic group with long religious and cultural traditions, who give a great importance to preserving their own cultural identity through generations. However, in recent years there are many economic, cultural and social changes in the life of the Cham Balamon community. One of the significant changes in the spiritual life of this community is the conversion of belief from Hinduism to Christianity. We think that this is an outstanding problem that needs to (...) be addressed by formal and comprehensive scientific research projects. We have dispatched several research groups to conduct field trips, deep interviews and sociological surveys on the spiritual life of the Cham Balamon community. This paper is the first step of those researches pointing out the problems and challenges to the Cham Balamon community in Ninh Thuan Province, Vietnam. These are cultural and belief conflicts among people in the community or even among family members. However, we would predict that the biggest challenge is the risk of losing cultural identities that the Cham Balamon community is facing today due to religious conversion. (shrink)

Network reconfiguration is one of the most effective methods to reduce line power loss in the distribution system, which causes higher losses than the other parts of the power system. This paper proposes a modified symbiotic organisms search algorithm to solve the NR problem. For the purpose of enhancing the effectiveness of MSOS, the mutualism and parasitism strategies of the original symbiotic organisms search have been modified to create better new solutions. In the mutualism strategy, the so-far best solution is (...) updated immediately as soon as new solutions are created. In the parasitism strategy, the update is only implemented for the first half of control variables, whereas another half still remains unchanged. The comparison results between MSOS and SOS on twenty-five benchmark functions and different scales of test distribution systems with 14, 33, 69, and 119 nodes show that the improvement level of MSOS over SOS is significant with higher success rates and better quality of gained solutions. Similarly, MSOS also reaches better results than other methods in the literature. Consequently, MSOS can be a favorable method for determining the most appropriate configurations for the distribution systems. (shrink)

History of political ideology in Vietnam.

The reproducibility crisis in social sciences has revealed significant weaknesses in conventional research practices, including selective publication, questionable statistical methods, and opaque peer review processes. This paper introduces Granular Interaction Thinking Theory (GITT) as a novel framework for understanding the plausibility of scientific findings, conceptualizing knowledge validation as a structured entropy-reduction process. Within this framework, open science practices—such as open data, open review, and open dialogue—initially increase informational entropy by exposing inconsistencies. However, through iterative refinement, they ultimately enhance the robustness (...) and plausibility of scientific knowledge. To systematically assess a study’s plausibility, we propose the Scientific Plausibility Index (SPI)—an entropy-based metric that integrates data and method transparency, replication success rates, and community engagement. Additionally, leveraging artificial intelligence (AI) and natural language processing (NLP), a dynamic plausibility-tracking system could be developed to detect unreliable claims early and accelerate scientific self-correction. This shift—from closed, one-time assessments to continuous, community-driven evaluation models—ensures that scientific knowledge remains rigorously tested and updated. We advocate for shifting from closed, one-time assessments to continuous, community-driven evaluation models, ensuring that scientific knowledge remains rigorously tested and updated. Ultimately, aligning incentives with entropy-reducing mechanisms—such as rewarding replication efforts and fostering open discourse—can cultivate a research culture that prioritizes robustness, transparency, and cumulative knowledge-building. We present an argument-based formalism of contract dispute resolution following a modern view that the court would resolve a contract dispute by enforcing an interpretation of contract that reasonably represents the mutual intention of contract parties. Legal doctrines provide principles, rules and guidelines for the court to objectively arrive at such an interpretation. In this paper, we establish the appropriateness of the formalism by applying it to resolve disputes about performance relief with the legal doctrines of impossibility and frustration of (...) purpose in common laws of contract. The formalism is based on modular argumentation, a recently proposed extension of assumption-based argumentation for modelling contract dispute resolution. (shrink)

What is a game? What are we doing when we play a game? What is the value of playing games? Several different philosophical subdisciplines have attempted to answer these questions using very distinctive frameworks. Some have approached games as something like a text, deploying theoretical frameworks from the study of narrative, fiction, and rhetoric to interrogate games for their representational content. Others have approached games as artworks and asked questions about the authorship of games, about the ontology of the work (...) and its performance. Yet others, from the philosophy of sport, have focused on normative issues of fairness, rule application, and competition. The primary purpose of this article is to provide an overview of several different philosophical approaches to games and, hopefully, demonstrate the relevance and value of the different approaches to each other. Early academic attempts to cope with games tried to treat games as a subtype of narrative and to interpret games exactly as one might interpret a static, linear narrative. A faction of game studies, self-described as “ludologists,” argued that games were a substantially novel form and could not be treated with traditional tools for narrative analysis. In traditional narrative, an audience is told and interprets the story, where in a game, the player enacts and creates the story. Since that early debate, theorists have attempted to offer more nuanced accounts of how games might achieve similar ends to more traditional texts. For example, games might be seen as a novel type of fiction, which uses interactive techniques to achieve immersion in a fictional world. Alternately, games might be seen as a new way to represent causal systems, and so a new way to criticize social and political entities. Work from contemporary analytic philosophy of art has, on the other hand, asked questions whether games could be artworks and, if so, what kind. Much of this debate has concerned the precise nature of the artwork, and the relationship between the artist and the audience. Some have claimed that the audience is a cocreator of the artwork, and so games are a uniquely unfinished and cooperative art form. Others have claimed that, instead, the audience does not help create the artwork; rather, interacting with the artwork is how an audience member appreciates the artist's finished production. Other streams of work have focused less on the game as a text or work, and more on game play as a kind of activity. One common view is that game play occurs in a “magic circle.” Inside the magic circle, players take on new roles, follow different rules, and actions have different meanings. Actions inside the magic circle do not have their usual consequences for the rest of life. Enemies of the magic circle view have claimed that the view ignores the deep integration of game life from ordinary life and point to gambling, gold farming, and the status effects of sports. Philosophers of sport, on the other hand, have approached games with an entirely different framework. This has lead into investigations about the normative nature of games—what guides the applications of rules and how those rules might be applied, interpreted, or even changed. Furthermore, they have investigated games as social practices and as forms of life. (shrink)

The current debate over aesthetic testimony typically focuses on cases of doxastic repetition — where, when an agent, on receiving aesthetic testimony that p, acquires the belief that p without qualification. I suggest that we broaden the set of cases under consideration. I consider a number of cases of action from testimony, including reconsidering a disliked album based on testimony, and choosing an artistic educational institution from testimony. But this cannot simply be explained by supposing that testimony is usable for (...) action, but unusable for doxastic repetition. I consider a new asymmetry in the usability aesthetic testimony. Consider the following cases: we seem unwilling to accept somebody hanging a painting in their bedroom based merely on testimony, but entirely willing to accept hanging a painting in a museum based merely on testimony. The switch in intuitive acceptability seems to track, in some complicated way, the line between public life and private life. These new cases weigh against a number of standing theories of aesthetic testimony. I suggest that we look further afield, and that something like a sensibility theory, in the style of John McDowell and David Wiggins, will prove to be the best fit for our intuitions for the usability of aesthetic testimony. I propose the following explanation for the new asymmetry: we are willing to accept testimony about whether a work merits being found beautiful; but we are unwilling to accept testimony about whether something actually is beautiful. Games have a complex, and seemingly paradoxical structure: they are both competitive and cooperative, and the competitive element is required for the cooperative element to work out. They are mechanisms for transforming competition into cooperation. Several contemporary philosophers of sport have located the primary mechanism of conversion in the mental attitudes of the players. I argue that these views cannot capture the phenomenological complexity of game-play, nor the difficulty and moral complexity of achieving cooperation through game-play. In this paper, I (...) present a different account of the relationship between competition and cooperation. My view is a distributed view of the conversion: success depends on a large number of features. First, the players must achieve the right motivational state: playing for the sake of the struggle, rather than to win. Second, successful transformation depends on a large number of extra-mental features, including good game design, and social and institutional features. (shrink)

I propose to study one problem for epistemic dependence on experts: how to locate experts on what I will call cognitive islands. Cognitive islands are those domains for knowledge in which expertise is required to evaluate other experts. They exist under two conditions: first, that there is no test for expertise available to the inexpert; and second, that the domain is not linked to another domain with such a test. Cognitive islands are the places where we have the fewest resources (...) for evaluating experts, which makes our expert dependences particularly risky. -/- Some have argued that cognitive islands lead to the complete unusability of expert testimony: that anybody who needs expert advice on a cognitive island will be entirely unable to find it. I argue against this radical form of pessimism, but propose a more moderate alternative. I demonstrate that we have some resources for finding experts on cognitive islands, but that cognitive islands leave us vulnerable to an epistemic trap which I will call runaway echo chambers. In a runaway echo chamber, our inexpertise may lead us to pick out bad experts, which will simply reinforce our mistaken beliefs and sensibilities. (shrink)

What could ground normative restrictions concerning cultural appropriation which are not grounded by independent considerations such as property rights or harm? We propose that such restrictions can be grounded by considerations of intimacy. Consider the familiar phenomenon of interpersonal intimacy. Certain aspects of personal life and interpersonal relationships are afforded various protections in virtue of being intimate. We argue that an analogous phenomenon exists at the level of large groups. In many cases, members of a group engage in shared practices (...) that contribute to a sense of common identity, such as wearing certain hair or clothing styles or performing a certain style of music. Participation in such practices can generate relations of group intimacy, which can ground certain prerogatives in much the same way that interpersonal intimacy can. One such prerogative is making what we call an appropriation claim. An appropriation claim is a request from a group member that non-members refrain from appropriating a given element of the group’s culture. Ignoring appropriation claims can constitute a breach of intimacy. But, we argue, just as for the prerogatives of interpersonal intimacy, in many cases there is no prior fact of the matter about whether the appropriation of a given cultural practice constitutes a breach of intimacy. This paper argues for the contemporary significance of the ‘Critique of Violence’ by proposing a Benjaminian reading of two important analyses of the relationship between history, politics and the Rights of Man: Hegel’s account of the French Revolution and the concept of dissensus proposed by Jacques Rancière. For both Hegel and Rancière, the gap between right and reality – between the ideal of equality, for example, and the existence of concrete inequality – does not warrant a rejection of the Rights (...) of Man. Rather, the gap is a constitutive condition of law and political rights. From the perspective of Benjamin’s ‘Critique of Violence’, however, these analyses serve to perpetuate a bourgeois legality, one that both Hegel and Rancière acknowledge can never be realized due to the constitutive discrepancy between right and reality. In preserving the promise of legal equality, these analyses preclude the possibility of a suspension or ‘absolution’ from law. This suspension of law is a task that Benjamin identified with the proletarian general strike, a strategy whose pure violence is supposed to secure what Benjamin described, enigmatically, as a ‘wholly transformed work’. Remarkably, however, the relationship between the suspension of law in a general strike and a total transformation of labour is never clearly defined in the ‘Critique’. This paper will develop an account of this relationship by pursuing the references to Marx’s critical theory of capitalism in Benjamin’s writings. (shrink)
